Appellate Law
After a court's decision has been rendered in a civil or criminal law trial, the losing party has the right to have the decision reviewed by a higher court. In the appeals process the lower court's judgment is presented to a higher court for further review. Appellate law is different than other forms of litigation since no discovery process is required, and the appellate case is limited to what was already presented in the lower trial court. An appellate case is presented to a multi-judge appellate panel and is usually decided almost entirely on the written briefs that the appellate attorney prepares.
What is an Appeal?
The appeals court provides a checks and balances system for judges and juries. The right to appeal an unfavorable legal decision is granted to you by the United States Constitution and individual state constitutions. The appealing party in an appellate case is referred to as the appellant. The appeals process allows the higher court the authority to reverse what it considers flawed, unconstitutional or inappropriate judgments rendered in lower courts.
